1Acceptance of Terms
By accessing and using Pxxl's deployment platform and hosting services ("Service"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations.
If you do not agree with any part of these terms, you may not use our Service.
These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
2Service Description
Pxxl provides a cloud deployment platform that enables instant deployment of websites and databases with zero configuration.
Our services include but are not limited to: automated builds, continuous deployment, database hosting (MongoDB, PostgreSQL, MySQL), custom domain configuration, SSL certificates, and CDN distribution.
We support over 20 programming languages and frameworks including React, Next.js, Vue.js, Angular, Node.js, Python, PHP, and HTML/CSS.
3Account Registration and Security
You must provide accurate, current, and complete information during registration.
You are responsible for maintaining the confidentiality of your account credentials.
You must notify us immediately of any unauthorized use of your account.
You may not use another person's account without permission.
Accounts are non-transferable and may not be shared between multiple users.
4User Responsibilities and Acceptable Use
Ensure all deployed content complies with applicable laws and our policies.
Not attempt to breach, test, or circumvent our security measures.
Not use our services for any illegal activities, including but not limited to copyright infringement, fraud, or distribution of malware.
Not engage in activities that could harm, disable, or impair our infrastructure.
Respect bandwidth and storage limitations associated with your plan.
Not use our services to send spam or unsolicited communications.
Maintain appropriate backups of your data and applications.
5Deployment and Hosting Terms
You retain all rights to your source code and application content.
By using our Service, you grant us the necessary rights to host, build, deploy, and distribute your applications.
We may impose reasonable limits on resource usage, including CPU, memory, storage, and bandwidth.
Deployments that violate these Terms or our policies may be suspended or terminated without notice.
We reserve the right to remove content that violates our terms or applicable laws.
6Data and Database Services
Database services are provided on a best-effort basis with regular backups.
You are responsible for maintaining your own backups of critical data.
We implement security measures to protect your data but cannot guarantee absolute security.
Data retention policies vary by plan and may be subject to automatic deletion after account termination.
Cross-border data transfers may occur as part of our global infrastructure.
7Service Availability and Performance
While we strive for maximum uptime, we do not guarantee uninterrupted access to our services.
Scheduled maintenance will be announced in advance when possible.
We reserve the right to modify, suspend, or discontinue any part of our Service with reasonable notice.
Service level agreements (SLAs) may vary by plan and are detailed in your subscription terms.
We are not liable for downtime caused by third-party services, internet connectivity issues, or force majeure events.
8Payment and Billing
Free tier services are provided subject to usage limitations and fair use policies.
Paid plans are billed in advance on a monthly or annual basis as selected.
All fees are non-refundable except as required by applicable law.
We reserve the right to change pricing with 30 days' notice to existing customers.
Failure to pay may result in service suspension or termination.
You are responsible for all taxes associated with your use of the Service.
9Intellectual Property Rights
You retain all intellectual property rights to your applications and content.
Pxxl retains all rights to our platform, infrastructure, and proprietary technology.
You may not reverse engineer, decompile, or attempt to extract our source code.
Our trademarks, logos, and brand elements may not be used without written permission.
You grant us a limited license to use your content solely for providing our services.
10Privacy and Data Protection
Our collection and use of personal information is governed by our Privacy Policy.
We implement industry-standard security measures to protect your data.
We may process your data in accordance with applicable data protection laws.
You have rights regarding your personal data as outlined in our Privacy Policy.
We do not sell or rent your personal information to third parties.
11Limitation of Liability
Pxxl shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
Our total liability shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.
We are not responsible for data loss, business interruption, or lost profits.
Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.
You agree to indemnify Pxxl against claims arising from your use of the Service.
12Termination
You may terminate your account at any time through your dashboard settings.
We may terminate or suspend your account for violation of these Terms.
Upon termination, your access to the Service will cease immediately.
Data retention after termination varies by plan and applicable law.
Provisions that should survive termination will remain in effect.
13Changes to Terms
We reserve the right to modify these Terms at any time.
Material changes will be communicated via email or platform notifications.
Continued use of our Service after changes constitutes acceptance of updated Terms.
If you disagree with changes, you may terminate your account.
The current version of these Terms is always available on our website.
14Force Majeure
Pxxl shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control.
Force majeure events include but are not limited to: acts of God, natural disasters, war, terrorism, civil unrest, government actions, labor strikes, internet outages, or failure of third-party services.
During force majeure events, our obligations under these Terms will be suspended to the extent affected by such events.
We will make reasonable efforts to notify users of force majeure events and their expected duration.
If a force majeure event continues for more than 30 days, either party may terminate the affected services with written notice.
15Third-Party Services and Integrations
Our Service may integrate with or rely on third-party services, APIs, libraries, and platforms.
We are not responsible for the availability, functionality, or terms of service of third-party providers.
Your use of third-party services through our platform is subject to their respective terms and privacy policies.
We may discontinue support for third-party integrations at any time with reasonable notice.
Third-party service failures or changes may affect the functionality of your deployments.
You are responsible for ensuring compliance with third-party service terms when using integrations.
16Export Control and Compliance
You agree to comply with all applicable export control laws and regulations.
You may not use our Service to export, re-export, or transfer technology or data to prohibited countries or entities.
You represent that you are not located in, or a national of, any country subject to trade embargoes or sanctions.
You will not use our Service for any purpose prohibited by applicable export control laws.
We reserve the right to suspend or terminate services to comply with export control requirements.
17Age Restrictions and Parental Consent
Our Service is not intended for use by individuals under the age of 13.
Users between 13 and 18 years of age must have parental or guardian consent to use our Service.
We do not knowingly collect personal information from children under 13.
If we become aware that a user is under 13, we will terminate their account and delete their data.
Parents or guardians may contact us to review, modify, or delete their child's information.
18Refund and Cancellation Policy
Free tier services may be cancelled at any time without refund obligations.
Paid subscriptions may be cancelled at any time, with service continuing until the end of the billing period.
Refunds are generally not provided except as required by applicable law or in cases of service failure.
Pro-rated refunds may be considered for extended service outages exceeding our SLA commitments.
Refund requests must be submitted within 30 days of the billing date.
Processing fees and third-party charges are non-refundable.
Cancelled accounts will retain access to paid features until the end of the current billing cycle.
19Service Monitoring and Analytics
We monitor our infrastructure and your deployments to ensure optimal performance and security.
Monitoring data may include performance metrics, error logs, and usage statistics.
We use this data to improve our services, detect issues, and prevent abuse.
Monitoring data is treated as confidential and is not shared with third parties except as required by law.
You may opt out of certain analytics features through your account settings.
We retain monitoring data for operational purposes and as required by our data retention policies.
20Beta Features and Experimental Services
We may offer beta, preview, or experimental features that are not part of our standard service offering.
Beta features are provided 'as-is' without warranties and may be unstable or incomplete.
We may discontinue, modify, or change beta features at any time without notice.
Data loss or service interruptions may occur when using beta features.
Beta features are not covered by our standard SLA commitments.
Feedback and usage data from beta features may be used to improve our services.
You participate in beta programs at your own risk.
21Content Takedown and DMCA Compliance
We respond to valid copyright infringement notices under the Digital Millennium Copyright Act (DMCA).
Copyright holders may submit takedown requests for infringing content hosted on our platform.
We will remove or disable access to allegedly infringing content upon receipt of valid DMCA notices.
Users may submit counter-notifications if they believe content was removed in error.
Repeat copyright infringers may have their accounts terminated.
DMCA notices should be sent to our designated copyright agent as specified in our Copyright Policy.
We reserve the right to remove content that violates our terms or applicable laws.
22API Terms and Developer Guidelines
Use of our APIs is subject to rate limiting and fair use policies.
API access may be revoked for abuse, excessive usage, or terms violations.
You may not use our APIs to create competing services or reverse engineer our platform.
API documentation and specifications may change with reasonable notice to developers.
You are responsible for keeping your API credentials secure and confidential.
Commercial use of our APIs may require a separate agreement or upgraded plan.
We provide APIs 'as-is' and do not guarantee backwards compatibility for all versions.
23Entire Agreement and Integration
These Terms, together with our Privacy Policy and any additional agreements, constitute the entire agreement between you and Pxxl.
These Terms supersede all prior or contemporaneous communications, proposals, and agreements relating to the subject matter herein.
No modification of these Terms will be effective unless in writing and signed by both parties.
If there is a conflict between these Terms and any additional agreements, the additional agreements will control for that specific service or feature.
Any waiver of any provision of these Terms will be effective only if in writing and signed by the party waiving the provision.
The failure to enforce any provision of these Terms shall not constitute a waiver of such provision or any other provision.
24Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severed from these Terms.
The invalidity, illegality, or unenforceability of any provision shall not affect the validity, legality, or enforceability of the remaining provisions of these Terms.
In the event of such severance, the remaining provisions shall continue in full force and effect.
We reserve the right to replace any severed provision with a valid, legal, and enforceable provision that achieves the same or similar effect as the original provision.
The parties agree to negotiate in good faith to replace any severed provision with terms that are as close as possible to the original intent.
25Legal Immunity and Waiver of Claims
To the maximum extent permitted by applicable law, you hereby waive any right to bring legal action, lawsuit, or claim against Pxxl, its officers, directors, employees, agents, or affiliates.
You acknowledge that Pxxl operates as a technology platform provider and shall not be held liable for any actions, decisions, or consequences arising from your use of the Service.
Any disputes shall be resolved through binding arbitration rather than litigation, where permitted by law.
You agree to release, defend, indemnify, and hold harmless Pxxl from any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from your use of the Service.
This waiver extends to all potential claims whether known or unknown, foreseen or unforeseen, existing or contingent.
Where local law prohibits such waivers, our liability shall be limited to the minimum extent permitted by applicable law.
26Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
Any disputes, claims, or controversies arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Nigeria.
All legal proceedings must be conducted in Nigeria, and you consent to the personal jurisdiction of Nigerian courts for the resolution of any such disputes.
You waive any right to participate in class action lawsuits.
If any provision of these Terms is found unenforceable, the remainder shall remain in effect.
